By accessing or using APEX Intelligence ("APEX", "we", "us", or "our") at apexstockintel.com, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the platform. These terms apply to all visitors, users, and others who access or use the service.

2. Description of Service

APEX Intelligence is a stock analysis platform that provides technical and fundamental market data, AI-generated analysis, and educational content. APEX is an informational tool only. Nothing on this platform constitutes financial advice, investment advice, trading advice, or any other type of advice. All analysis is for educational and informational purposes only.

3. Not Financial Advice

APEX Intelligence is NOT a registered investment advisor, broker-dealer, or financial planner. The signals, scores, verdicts, and analysis provided by APEX are algorithmic outputs based on publicly available market data. They are not recommendations to buy, sell, or hold any security. Past performance of any signal or indicator does not guarantee future results. You are solely responsible for any investment decisions you make. Always consult a qualified financial advisor before making investment decisions.

4. User Accounts

To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate information when creating your account. APEX reserves the right to terminate accounts that violate these terms.

5. Subscriptions and Billing

APEX offers a free tier and paid subscription plans (Pro and Elite). Paid subscriptions are billed monthly via Stripe. You may cancel your subscription at any time; access continues until the end of the current billing period. No refunds are issued for partial months. We reserve the right to change pricing with 30 days notice.

6. Acceptable Use

You agree not to: (a) scrape, reverse engineer, or copy the platform or its data; (b) use automated tools to access the service at scale; (c) resell or redistribute APEX analysis without written permission; (d) attempt to gain unauthorized access to any portion of the service; (e) use the service for any unlawful purpose.

7. Intellectual Property

All content on APEX Intelligence, including text, graphics, logos, and software, is the property of APEX Intelligence and is protected by copyright and intellectual property laws. You may not reproduce, distribute, or create derivative works without express written permission.

8. Data and Privacy

Your use of APEX is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using APEX, you consent to the collection and use of your data as described in the Privacy Policy.

9. Disclaimer of Warranties

APEX Intelligence is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the service will be uninterrupted, error-free, or free of viruses. Market data may be delayed or inaccurate. We disclaim all liability for any losses arising from reliance on APEX outputs.

10. Limitation of Liability

To the fullest extent permitted by law, APEX Intelligence shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or investment losses, even if advised of the possibility of such damages. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising under these terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or platform notification. Continued use of APEX after changes constitutes acceptance of the new terms.
