1. Acceptance of Terms
By accessing or using Apex Stock Intel ("Service", "Platform", "we", "us", "our") at apexstockintel.com, creating an account, or clicking "I Agree" during registration, you ("User", "you") agree to be bound by these Terms of Service. If you do not agree, you may not access or use the Service. BY CREATING AN ACCOUNT, YOU EXPLICITLY ACKNOWLEDGE THAT: Apex Stock Intel is an educational and informational tool only; no content constitutes financial or investment advice; you are solely responsible for all investment decisions you make; investing in securities involves substantial risk of loss, including loss of principal.
2. Description of Service
Apex Stock Intel is an AI-powered stock analysis and education platform that provides technical signal analysis (RSI, MACD, Bollinger Bands, Moving Averages, Volume, Sentiment, Fundamentals), supply chain intelligence visualizations, narrative and sentiment analysis, market data displays, and educational content through Signal Academy. THE SERVICE IS PROVIDED FOR EDUCATIONAL AND INFORMATIONAL PURPOSES ONLY.

Apex Stock Intel is NOT a registered investment advisor, broker-dealer, financial planner, or any other type of regulated financial service. The Service does not provide investment advice, financial advice, trading recommendations, or any form of advice regarding the purchase, sale, or holding of any security. All analysis scores, signals, composite scores, supply chain maps, narrative analyses, exit plans, and macro regime analyses are provided solely for educational and informational purposes — not personalized to your financial situation, investment objectives, tax status, or risk tolerance. YOU ARE SOLELY AND EXCLUSIVELY RESPONSIBLE FOR ALL INVESTMENT DECISIONS YOU MAKE. By using the Service, you acknowledge that all investing involves risk including possible loss of principal, past performance does not guarantee future results, and no analysis tool can guarantee profitable outcomes.
4. Eligibility
To use the Service, you must be at least 18 years of age, have the legal capacity to enter into a binding agreement, not be prohibited from using the Service under any applicable law, and reside in a jurisdiction where accessing such services is legal. The Service is not intended for use in jurisdictions where such use would be contrary to law or regulation.
5. User Accounts
To access certain features, you must create an account. You agree to provide accurate, current, and complete information and to keep it updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You may maintain only one account — creating multiple accounts to circumvent usage limits or payment requirements is prohibited and will result in account termination. 6. Subscription Plans and Payment
Apex Stock Intel offers: Free Plan (limited analyses per month at no charge), Pro Plan ($19.00 USD/month — unlimited analyses and full feature access), and Elite Plan ($49.00 USD/month — all Pro features plus exclusive premium features). Paid subscriptions are billed monthly in advance. By subscribing, you authorize recurring monthly charges until you cancel. We reserve the right to change prices with at least 30 days' notice via email. You are responsible for all applicable taxes. If a payment fails, we will retry; after repeated failure, your account may be downgraded or suspended.
7. Refund Policy
First-time paid subscribers may request a full refund within 14 days of their initial subscription payment. After 14 days, all subscription fees are non-refundable. When you cancel, you retain access through the end of your current billing period. No partial refunds are issued for unused time. If the Service experiences an unplanned outage exceeding 4 consecutive hours caused solely by Apex Stock Intel infrastructure, you may request a pro-rated service credit (not a cash refund). 8. Service Availability
We will use commercially reasonable efforts to keep the Service available, but do not guarantee uninterrupted or error-free service. The Service may be temporarily unavailable due to scheduled maintenance, third-party service outages (Vercel, Supabase, Anthropic API, Finnhub, Yahoo Finance, Stripe), internet infrastructure failures, cyberattacks, natural disasters, or other events beyond our control. WE ARE NOT LIABLE FOR ANY DAMAGES, LOSSES, OR MISSED INVESTMENT OPPORTUNITIES ARISING FROM SERVICE UNAVAILABILITY.
9. Prohibited Uses
You agree NOT to: use the Service for any unlawful purpose; attempt to reverse engineer or extract source code; scrape or systematically download data; share, resell, or redistribute account credentials; use the Service to create a competing product; attempt to circumvent usage limits or paywalls; misrepresent APEX output as financial advice; use automated tools without permission; violate any applicable securities laws; or use APEX output to provide investment advice to third parties without proper licensing.
10. Intellectual Property
All content on the Service — including text, graphics, logos, algorithms, software, analysis methodologies, Signal Academy content, and the APEX brand — is owned by or licensed to Apex Stock Intel and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes. Market data is sourced from third-party providers including Finnhub and Yahoo Finance, subject to their respective terms.
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, APEX INTELLIGENCE EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT; WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE; WARRANTIES THAT ANY ANALYSIS OR SIGNAL WILL BE ACCURATE; AND WARRANTIES THAT USING THE SERVICE WILL RESULT IN PROFITABLE OUTCOMES.
12. Limitation of Liability
APEX INTELLIGENCE SHALL NOT BE LIABLE FOR ANY INVESTMENT LOSSES, TRADING LOSSES, LOST PROFITS, OR ANY OTHER FINANCIAL LOSSES ARISING FROM YOUR USE OF OR RELIANCE ON THE SERVICE. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF: (A) SUBSCRIPTION FEES YOU PAID IN THE THREE MONTHS PRECEDING THE CLAIM; OR (B) $100.00 USD. IN NO EVENT SHALL APEX INTELLIGENCE BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. YOU ACKNOWLEDGE THESE LIMITATIONS ARE A FUNDAMENTAL PART OF THE BARGAIN.
13. Indemnification
You agree to indemnify, defend, and hold harmless Apex Stock Intel, its owners, officers, employees, contractors, and affiliates from any claims, liabilities, damages, losses, costs, and expenses (including legal fees) arising from: your use of the Service; your violation of these Terms; your investment decisions made based on information from the Service; your violation of any applicable laws; or any content you submit.
14. Termination
You may cancel your subscription and close your account at any time through account settings or by emailing [email protected]. We may suspend or terminate your account at any time, with or without notice, for violation of these Terms, suspected fraudulent or abusive activity, non-payment, extended inactivity, or cessation of the Service. Upon termination, your access immediately ceases. Sections 3, 11, 12, 13, and 15 survive termination.
15. Dispute Resolution
These Terms are governed by the laws of the jurisdiction in which Apex Stock Intel is registered. Before filing any formal legal claim, you agree to attempt informal resolution by contacting us at [email protected]. Disputes that cannot be resolved informally shall be resolved through binding arbitration. YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION. You may opt out of the arbitration provision by emailing [email protected] within 30 days of first accepting these Terms.
16. General Provisions
These Terms, together with our Privacy Policy and Financial Disclaimer, constitute the entire agreement between you and Apex Stock Intel. We reserve the right to modify these Terms at any time, with 30 days notice for material changes. Your continued use after changes take effect constitutes acceptance.
